While Federal agencies, including HHS, are further developing guidance for the trustworthy use of AI for internal projects, State partners are seeking to establish their own AI governance frameworks to effectively identify the opportunities, and associated risks, of current and future AI implementations across HHS agencies, external providers and vendor partners.  Over twenty-five states and territories have introduced AI bills this year, and at least fourteen states and Puerto Rico have enacted legislation that delegates research obligations to government entities to increase institutional knowledge of AI and better understand its possible consequences.

Artificial intelligence (AI) holds extraordinary potential for healthcare transformation overall, through process automation, and enhanced analytical and knowledge management capabilities.

State HHS agencies, in particular, lie at the nexus for many of the challenges, AI promises to solve - including significant labor and skills shortages, and budgetary constraints, furthermore, they operate in a heavily regulated environment, in many cases still operating outdated legacy IT infrastructure. 

As increased AI adoption unlocks new value, it also introduces reputational, regulatory, operational, and legal risks. To achieve the full benefits of AI across the HHS ecosystem, states must mitigate those risks by embedding principles that foster trust in each stage of AI development. As states use AI to advance the health and well-being of beneficiaries, they must maintain public trust by ensuring that our solutions are ethical, effective, and secure.
